Qualified Electronic Signature

A Qualified Electronic Signature (QES) is the highest level of electronic signature defined by the eIDAS regulation. It benefits from a presumption of legal validity equivalent to a handwritten signature in all European Union Member States.

The qualified electronic signature is distinguished from simple and advanced signatures by two additional requirements: it must be created using a Qualified Signature Creation Device (QSCD) and rely on a qualified certificate issued by a Qualified Trust Service Provider (QTSP). This triple layer of assurance makes it the most reliable instrument for transactions with high legal value.

The process of issuing a qualified signature involves rigorous identity verification of the signatory, compliant with eIDAS high assurance level. This verification can be carried out in person or remotely via a certified video journey including liveness detection. The qualified certificate is then stored on a secure device (smart card, cloud HSM) that ensures the private key cannot be duplicated.

The QES is particularly used in sectors subject to strict regulatory requirements: notarial deeds, financial contracts, administrative documents, public procurement. It is the only level of electronic signature that Member States cannot refuse on the grounds that it is electronic rather than handwritten.
